Terms of Service

Welcome to MixMe. By using the MixMe mobile application (the “App”), you agree to these Terms of Service (“Terms”). Please read them carefully.

1. Acceptance of Terms

By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

MixMe is a mobile application that uses artificial intelligence to generate music playlists based on your text descriptions and musical preferences. The App also allows you to:

• Save and manage generated playlists
• Export playlists to connected streaming services
• Share playlists with other users via public links
• Listen to track previews or full tracks via connected streaming accounts
• Build and refine your musical taste profile over time

3. Account

3.1 Registration

You must create an account to use most features. You can register with email/password or via third-party authentication (Apple, Google). You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Deletion

You can delete your account at any time from Profile > Account > Delete Account. Deletion is permanent and will remove all your data (playlists, preferences, connected accounts) within 30 days.

4. Subscriptions & Payments

4.1 Free Tier

MixMe offers a free tier with limited features (capped generations per month, limited saved playlists, basic track count).

4.2 MixMe Premium

MixMe Premium is a paid subscription that unlocks unlimited generations, unlimited saved playlists, advanced prompt builder, playlist export, sharing, and more.

4.3 Billing

4.4 Auto-Renewal & Cancellation

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your device’s subscription settings (App Store or Google Play).

4.5 Refunds

Refunds are handled by Apple (App Store) or Google (Google Play) according to their respective refund policies. MixMe does not process refunds directly.

5. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use automated systems (bots, scrapers) to access the App
• Circumvent usage limits, subscription checks, or security measures
• Share or resell your account or subscription
• Submit prompts that are abusive, hateful, or designed to generate harmful content
• Misrepresent AI-generated playlists as human-curated editorial content

6. Intellectual Property

6.1 MixMe Content

The App, its design, code, branding, and AI models are the property of MixMe and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the App.

6.2 Your Content

You retain ownership of the prompts you submit and the playlists you generate. By making a playlist public, you grant MixMe a non-exclusive license to display it within the App’s community features.

6.3 Music Content

MixMe does not own or host music content. Playback and streaming are provided through third-party services (Spotify, Apple Music, Deezer, YouTube Music, MusicMe) subject to their respective terms and licenses. Track previews are provided under fair use for identification purposes.

The App integrates with third-party streaming services. Your use of those services is governed by their own terms:

MixMe is not responsible for the availability, content, or policies of third-party services.

9. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, MixMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or interruption of service.

11. Indemnification

You agree to indemnify and hold harmless MixMe from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Continued use after changes constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the App if you violate these Terms or engage in harmful behavior. You may terminate your account at any time by deleting it from the App.

14. Governing Law

These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.
